Prospera Hotels, LLC (“Prospera”) respects your privacy and is committed to collecting, maintaining and using personal information about you responsibly.  Your use of this Prospera website (“Site”) signifies your acceptance of the terms of this Privacy Policy (“Privacy Policy”) and the accompanying terms of use, which are incorporated herein by this reference.  BY USING THE SITE YOU AGREE TO THIS PRIVACY POLICY.  PLEASE READ IT.

PURPOSE – This Privacy Policy is designated to inform you about what personally identifiable information (“PII”) the Site collects, and what will be done with it.  PII is understood to refer to information that would allow you to be identified or contacted, such as your name, physical address, e-mail address or telephone number.  You may be accessing this Site from a computer or mobile device (for example through a mobile phone, iPhone, iPad, or other electronic mobile device) and this Privacy Policy governs your use of this Site regardless of the means of access.

INFORMATION WE COLLECT  – You are not required to submit PII to use this Site.  Although Prospera does not collect PII from you based on your use of this Site, you may voluntarily elect to provide PII to Prospera by means of e-mail or other communication.  When you submit PII on or through this Site or a Third Party Site, you are giving your consent to the collection, use and disclosure of PII about you in accordance with this Privacy Policy and applicable law.  If you choose to share information about yourself in an open format, such as through a Third Party Site like LinkedIn, we may construe certain of that information to be public information – and not personal information.  If you have made an inquiry of Prospera regarding the availability of services or have otherwise consented, Prospera may elect to use your PII to provide you with invitations and other mailings that may be of interest to you.  You may opt-out of such mailings, submit corrections to your PII, or have your PII removed from Prospera’s contact database at any time by contacting us at the address listed below.  We will retain your PII for the period necessary to fulfill the purposes outlined in this Privacy Policy unless a longer retention period as required or allowed by law.

COLLECTION OF TRAFFIC DATA – Like most websites, the server upon which this Site resides automatically collects basic data about your visit to this Site from your browser or device, including your computer’s IP address, certain environmental variables (for example, your MAC address, computer type, web browser type, operating system type, etc.) and what pages linked you to this Site.  We refer to this server-collected information as “Traffic Data.”  Prospera may utilize such aggregated Traffic Data to interpret the usefulness and popularity of the Site, and to develop improvements to it.  Prospera may make Traffic Data available to employees, contractors or other third parties to the extent necessary for them to perform certain Site-related service on behalf of Prospera.

HOW WE USE YOUR INFORMATION – Prospera may use PII provided by you in the following ways:  1) responding to inquiries or requests for service (including but not limited to information newsletters or online publications); 2) providing notice of administrative changes to the terms, conditions, and policies of the Site or Third Party Sites; and 3) internal business purposes, such as information technology, maintenance and internal auditing.  Information provided by you which does not constitute PII may be used for any lawful purpose and may be shared with third parties.

SHARING OF YOUR INFORMATION  – Your PII may be shared with third parties under certain circumstances, including:  1) situations in which you have given your express consent; 2) when a service provided on this Site requires that PII be shared with a service provider that has agreed not to disclose the information to third parties; 3) to comply with legal process or pursuant to a lawful request by a court of competent jurisdiction or upon presentation of a valid law enforcement warrant; 4) to protect and defend the legitimate business interest, rights or property of Prospera; 5) for internal business purposes of a service provider, such as third-party auditing; and 6) in urgent circumstances, to protect personal or public safety.  We may also exchange information, including PII, with other companies and organizations for credit fraud protection, risk reduction, and to address cyber security risks and/or data breaches.

CHILDREN’S PRIVACY – Prospera is committed to complying with the Children’s Online Privacy Protection Act (COPPA).  Our Site and services are not directed to children under the age of 13.  We do not knowingly collect personal information from children under the age of 13.  If we receive personal information that we discover was provided by a child under the age of 13, we will promptly destroy such information. We encourage parents with concerns to contact us. CHANGES TO THE POLICY – Prospera reserves the right to change, modify or update this Privacy Policy at any time without notice.  Any substantial changes in the way your personal information is used will be posted here. Your use if this Site following these changes constitutes your acceptance of any revised Privacy Policy. If you do not accept the Privacy Policy, you must discontinue use of the Site immediately.

IMPORTANT INFORMATION REGARDING CALIFORNIA RESIDENTS

DO NOT TRACK  – California Business & Professions Code section 22575(b) (as amended) provides that California residents are entitled to know how a website operator responds to “Do Not Track”(DNT) browser settings.  Some browsers or other tools include DNT features which, when turned on, send a signal to websites you visit indicating that you do not wish to be tracked across websites over time.  The Worldwide Web Consortium has been working with industry groups and regulators to develop a DNT browser technology standard to provide a standard for interpreting the DNT signals, but to date no final standard has been adopted.  Prospera does not currently take actions to respond to DNT signals.  We continue to review new technologies and may adopt a DNT standard once one is created.  For more information about DNT, please visit:  www.allaboutdnt.org.

YOUR CALIFORNIA PRIVACY RIGHTS – California Civil Code section 1798.83 permits users who are California residents to request and obtain certain information regarding Prospera’s disclosure of personal information (if any) to third parties for their direct marketing purposes.  To make such a request, please send an e-mail to or write us at the address listed below.  We will provide a list of the categories of PII disclosed to third parties for their direct marketing purposes during the immediately preceding calendar year, along with the names and addresses of these third parties.  Only one request may be made during the calendar year and are free of charge.

INTERNATIONAL DATA TRANSFERS: Prospera is headquartered in the United States but may have service providers located in other countries. Your personal information may be transferred to the United States or other locations outside of your state, province, our country where privacy laws may not be as protective as those in your state, province, or country. By using the Prospera website from outside of the United States, you expressly consent to the transfer of information out outside of your country.
